Welcome to Viventii! These Terms of Service ("ToS") govern your access to and use of the Viventii platform. By accessing or using our services, you agree to these ToS and our **Privacy Policy**.

1. Scope and Definitions

"Platform" refers to the websites, mobile applications, and services of Viventii. "User" refers to all individuals who access the platform, including visitors and registered members. "Organizer" refers to users who have a verified organizer account. "Content" refers to all data, texts, images, videos, and information published by users on the platform.

2. Our Role as a Platform

Viventii is a platform that allows organizers to promote events and visitors to discover them. **We are expressly not the organizer, promoter, or seller of the events listed on the platform.** We are not responsible for the execution, quality, safety, or legality of the events. Any contractual relationship regarding an event is exclusively between the organizer and the visitor.

3. User Account and Obligations

An account is required to use many features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide truthful and complete information during registration and to keep it up-to-date. The use of the platform is subject to our **Community Guidelines**, which are an integral part of these ToS.

4. User-Generated Content

a) Your Responsibility for Your Content

You are solely responsible for all content that you upload, publish, or otherwise make available on Viventii. You guarantee that you have all necessary rights (especially copyright, trademark, and personal rights) to your content and that your content does not violate any laws or the rights of third parties.

b) Granting a License to Viventii

To enable us to operate and promote our platform, you grant Viventii a non-exclusive, transferable, sublicensable, royalty-free, and worldwide license to use, reproduce, publicly display, distribute, modify, and create derivative works of your content in connection with the operation of the Viventii services.

5. Intellectual Property and Reporting Violations

a) Our Role as a Hosting Provider

**Viventii acts purely as a hosting provider and does not proactively review user-uploaded content for potential legal violations.** We are not obligated to monitor content. However, we respond to reports of alleged copyright and other legal infringements.

b) Procedure for Reporting Infringements (Notice-and-Takedown)

If you believe that content on Viventii infringes your copyright, trademark, or other rights, please report it to us via our **Support Form**. Your report must contain sufficient information to identify the infringement and to prove your entitlement. Upon receipt of a valid report, we will promptly remove or block access to the content in question and inform the relevant user.

6. Prohibited Activities and Community Guidelines

The use of the platform for illegal, harmful, or fraudulent activities is strictly prohibited. All users must adhere to our **Community Guidelines**. Violations may result in the immediate suspension or deletion of your account. We reserve the right to remove content and suspend accounts that violate our policies.

7. Advertising Services and Billing

Organizers can book paid advertising services. The details, prices, and billing models (e.g., Cost-Per-Click for ticket links) are transparently displayed during the booking process. By booking, you agree to the payment terms stated therein. All prices are exclusive of statutory VAT.

8. Disclaimer and Warranty

The use of the Viventii platform is at your own risk. The services are provided "as is" and "as available" without any warranty. Viventii assumes no liability for the accuracy, completeness, or timeliness of the information provided by users, the execution of events, or for damages arising from the interaction between users. Our liability is limited to intent and gross negligence, except in cases of injury to life, body, health, or essential contractual obligations.

9. Termination and Cancellation

You can delete your account at any time in your profile settings. Viventii may suspend or terminate your access to the platform at any time for good cause, especially in case of violations of these ToS, without prior notice.

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is the registered office of Viventii, provided the user is a merchant. Should individual provisions of these ToS be ineffective, the validity of the remaining provisions shall remain unaffected. Viventii reserves the right to change these ToS at any time. You will be informed of significant changes. Your continued use of the platform after such a change constitutes your consent to the new ToS.

Community Guidelines

Viventii should be a safe and positive place for everyone. Every user is responsible for adhering to these guidelines.

  • Respectful Interaction: Treat other users with respect. Hate speech, bullying, harassment, and threats are strictly forbidden and will lead to immediate suspension.
  • Authenticity: Be yourself. Do not impersonate another person or organization. Misleading or false information in profiles or events is not permitted.
  • Safety: The organization of or promotion of dangerous or illegal activities, including violence, fraud, or the sale of regulated goods, is prohibited.
  • Appropriate Content: Do not post content that depicts or promotes explicit violence, sexual content, self-harm, or hatred. Spam and misleading commercial content are also not allowed.
  • Intellectual Property: Only share photos, texts, and other content for which you own the rights or have permission to publish.
  • Reporting Violations: If you see content or behavior that violates these guidelines, please use the reporting feature on the platform or contact our support.
